This regulation specifies White Australia (including the aliases White Australia Party and WAP) as a prohibited hate group under Part 5.3B of the Criminal Code Act 1995 (Cth).
The listing takes effect on 16 May 2026.
All members must immediately take all reasonable steps to cease being a member of the organisation.
To formally resign your membership (which will assist you in establishing the statutory defence under s 114B.1):
Send a short email to [email protected]
In the body of the email, state exactly:
“I hereby resign my membership of White Australia Party Inc. effective immediately.”
Keep a copy of your sent email (including the date and time stamp) for your records.
This email address will be unmonitored post 12:00am. The sending of the email will serve as proof of immediate reasonable steps undertaken by our members to cease being a party member.
Continued membership or engagement after 16 May 2026 may expose individuals to serious criminal liability under Division 114B of the Criminal Code, including offences carrying up to 15 years’ imprisonment.
The Party has today commenced urgent proceedings in the High Court of Australia challenging the validity of the listing and the underlying legislation. We will provide further updates as soon as they are available.
This notice is issued to assist members in taking the reasonable steps required by law.
Yours sincerely,
Thomas Anthony Sewell
National President
