United States v. Skrmetti Oral Argument
By a vote of 6-3, the Supreme Court upheld Tennessee's ban on transgender medical treatments for minors, ruling it did not violate the 14th Amendment's Equal Protection Clause. Chief Justice John Roberts wrote: "This case carries with it the weight of fierce scientific and policy debates ... of medical treatments in an evolving field. The Equal Protection Clause does not resolve these disagreements." The ruling does not affect states that do not have such bans. Tennessee enacted the law in 2023, which asserted there was a "compelling interest" to protect minors from harm by banning health care providers from administering hormone therapy, puberty blockers, and surgery to minors for transgender purposes. Minors and their families sued the state, and the Justice Department under President Biden intervened for them, arguing the law discriminated on the basis of sex. Chase Strangio, the lawyer for trans minors and their parents, was the first openly trans lawyer to argue before the Court.
