Former Assistant Virginia Attorney General and UVA Counsel Tim Heaphy Admits UVA’s DEI Programs Crossed Legal Lines Including Title VI, Title VII, and Title IX After Political Administrations Signaled It Was Acceptable to Break Civil Rights Law to Advance DEI
I came across this recent lecture from the UVA Retired Faculty Association. What is striking is how openly Tim Heaphy, former assistant Virginia attorney general, former University Counsel, special counsel for the Jan. 6 Committee, and a major figure in UVA legal and political circles, responds when a retired professor presses him on whether UVA’s DEI apparatus was built around equality of outcome.
The professor notes that UVA’s DEI training used the classic “three people looking over the fence” equity graphic and that UVA’s own Equity Center even adopted an abstract version of it as their logo. Despite President Ryan publicly insisting that UVA’s DEI was not about equality of outcome, the framework in practice was clearly oriented toward exactly that.
Heaphy acknowledges that UVA ran DEI programs that crossed legal lines and used numerical formulas to shape outcomes.
“I do think that the university historically has had some programs that crossed the legal line… in certain schools or certain departments had numerical formulas and it was against the rules.”
Then comes the most explosive statement. Heaphy says UVA operated this way because previous political administrations signaled they would not enforce federal civil rights law if breaking it was necessary to advance DEI.
“There were prior administrations, political administrations, that made clear that they weren’t going to enforce Title VI, Title VII, Title IX in that way. So I can’t stand here and say that everything the university has done historically has been an adherence of that line.”
This is a short exchange but an enormous admission, so here is what we just learned.
• UVA DEI was oriented around equality of outcome, despite President Ryan’s denials
• UVA ran programs that crossed the legal line
• Those programs created Title VI, Title VII, and Title IX liability
• They persisted because enforcement was politically dormant and willing to turn a blind eye

He was punched roughly 15 times in the face. He never threw a punch himself, instead he struggled to retrieve his cross.
