I’ll tell you what the real “shadow docket” was — many of the cases decided by the Warren Court making up new rights out of whole cloth. Decisions not based on the text, structure, or logic of the Constitution but instead based on shadowy “penumbras” or mirages they wanted to in the Constitution but were not there.
The Left is good at using rhetoric to frame things from their biased perspective.
Call the current “shadow docket” what it is — the Supreme Court’s “stay docket” or “emergency docket.” Don’t be fooled by rhetorical types and shadows and fall for loaded terms.
